By enrolling in a course, you receive a personal, non-transferable license to access materials strictly for your own learning. Unauthorized sharing or resale of training materials will result in immediate revocation of access and potential legal action.

 

2.4. USAGE RESTRICTIONS AND PERMISSIONS

 

Your use of our Content and Services is subject to the following conditions:

4.17. Reverse Engineering: Modify, decipher, decompile, or disassemble our software, including but not limited to Flash, PHP, HTML, and JavaScript.

4.18. Unauthorized Scripts & Tools: Launch, develop, or distribute automation tools such as scrapers, bots, or exploit software.

Filmmakers participating in the festival may submit additional promotional content, including but not limited to trailers, posters, behind-the-scenes footage, interviews, and other marketing assets. By submitting these materials, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, publicly display, and promote them in connection with the festival.

 

5.2. Usage and Promotion Rights

 

Filmmakers may submit trailers, posters, and other promotional assets to help showcase their film. By providing these materials:

 

5.2.1. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and promote them in connection with the festival on our official website, social media channels, press releases, email campaigns, and other marketing platforms to enhance the visibility of your film and the festival.

5.2.2. These materials may be adapted or reformatted as necessary to fit different platforms while maintaining their integrity.

5.2.3. We are not obligated to use every submitted promotional item but reserve the right to determine how and where they are displayed.

 

5.3. Filmmaker Responsibilities

 

Filmmakers must ensure they have the necessary rights and permissions for all submitted materials. By providing content, you confirm that:

 

5.3.1. You confirm that you have all necessary rights and permissions to submit and authorize the use of these materials.

5.3.2. You must ensure that any submitted content does not infringe upon third-party rights, including copyright, trademarks, or privacy rights.

5.3.3. If a third party claims infringement, you agree to indemnify and hold us harmless from any legal claims, damages, or liabilities arising from the use of your materials.

 

5.4. Content Removal & Withdrawal

 

If a filmmaker wishes to withdraw or modify the use of their promotional materials, they may request removal, subject to reasonable limitations. Key conditions include:

 

5.4.1. Requests must be submitted in writing, and while we will make efforts to comply, previously published materials may remain available on external platforms.

5.4.2. We reserve the right to remove or restrict any content deemed inappropriate, offensive, or in violation of our policies.

 

  1. SERVICES MANAGEMENT AND AVAILABILITY

 

We strive to provide a seamless and high-quality experience through our festival platform, ensuring accessibility, reliability, and smooth operation for all users. However, the availability of our services may be subject to various factors, including maintenance, technical issues, and external conditions beyond our control.

 

6.1. PLATFORM MAINTENANCE AND UPDATES

 

To maintain the integrity and functionality of our services, we may perform routine or emergency maintenance, which could impact accessibility.

 

6.1.1. Scheduled maintenance periods will be communicated in advance whenever possible.

6.1.2. We may implement updates, improvements, or security patches to enhance performance, usability, and protection.

6.1.3. Some features may be temporarily limited or unavailable during these updates.

 

6.2. SERVICE AVAILABILITY AND DOWNTIME

 

While we aim for continuous uptime, we cannot guarantee uninterrupted service. The platform’s availability may be affected by:

  • Remove your submissions or materials if they breach ethical, legal, or content guidelines.
  • Revoke participation for fraudulent activities, abusive behavior, or attempts to manipulate the selection process.

If your participation is terminated, you forfeit any associated fees, and we are not liable for any losses incurred.

 

  1. CHANGES AND SERVICE MODIFICATIONS

 

We may update, modify, or discontinue parts of our services, policies, or Terms at any time. This includes:

  • Adjustments to submission guidelines, deadlines, or festival format.
  • Changes in pricing, refund policies, or service offerings.
  • Updates due to legal requirements, platform improvements, or industry standards.

We will notify users of significant changes where possible. Continued use of our services after changes indicates acceptance of the revised Terms.

 

  1. GOVERNING LAW AND JURISDICTION

 

These Terms and any disputes arising from them shall be governed by and interpreted in accordance with the laws of England.

 

  1. DISPUTE RESOLUTION AND REFUND POLICY

 

We encourage resolving disputes amicably and in good faith. If a resolution cannot be reached through discussion, disputes shall be:

  • Subject to the jurisdiction of the courts of England.
  • Resolved in compliance with applicable consumer protection laws.

We understand that plans may change, and we strive to offer fair and transparent refund and cancellation policies for all ticketed events, including festival screenings, networking events, and training courses. Please review the following policies carefully before making a purchase.

 

11.1. Festival Tickets

 

11.1.1. Cancellation by Attendee:

  • If you cancel at least 14 days before the festival date, you are eligible for a 50% refund of your ticket price.
  • Cancellations made less than 14 days before the festival date are non-refundable.
  • No refunds will be issued for no-shows or last-minute cancellations.

11.1.2. Cancellation by London Film Club:

  • If the festival is postponed or canceled for unforeseen reasons (e.g., venue issues, force majeure), we will offer either one of the below options:
    1. A full refund
    2. The option to transfer your ticket to the next festival edition.

11.2. Networking Events

 

11.2.1. Cancellation by Attendee:

  • Cancellations made at least 7 days before the event are eligible for a 50% refund.
  • Cancellations made less than 7 days before the event are non-refundable.
  • If you are unable to attend, you may transfer your ticket to another individual by contacting us at least 48 hours in advance.

11.2.2. Event Rescheduling or Cancellation:

  • If we need to reschedule or cancel a networking event, we will offer either one of the below option:
    1. Receive a full refund
    2. Transfer your ticket to the rescheduled date or a future event.

11.3. Training Courses and Workshops

  • Cancellation by Attendee:
    • If you cancel at least 21 days before the course start date, you will receive a 75% refund.
    • If you cancel between 10-20 days before the start date, you will receive a 50% refund.
    • Cancellations made less than 10 days before the course start date are non-refundable.
    • If you are unable to attend, you may request to transfer your enrollment to a future session (subject to availability).
  • Cancellation or Changes by London Film Club:
    • If a course is canceled or postponed, we will offer either one of the below option:
      • A full refund
      • The option to enroll in a future session.

11.4. General Refund Conditions

  • Refunds will be processed via the original payment method and may take up to 10 business days to reflect in your account.
  • All refund requests must be made in writing via email to contact@londonfilmclub.uk.
  • Processing fees may apply to certain refunds, and credit card fees are non-refundable.

By purchasing tickets or enrolling in courses, you acknowledge and accept this refund policy.

 

  1. ERRORS AND CORRECTIONS

 

We strive for accuracy in all festival-related materials but reserve the right to:

 

12.1. Correct errors, inaccuracies, or omissions in published information.

12.2. Update content, schedules, or guidelines as necessary.

12.3. Modify selections or participant listings if errors are discovered after publication.

 

These corrections may occur without prior notice.

 

  1. DISCLAIMERS AND WARRANTIES

 

The festival and its services are provided “as is” without warranties of any kind, expressed or implied. We do not guarantee:

 

13.1. Selection of any film. Submission does not ensure inclusion.

13.2. Positive reception or outcomes from participation.

13.3. Uninterrupted service, as technical issues may arise.

 

We disclaim liability for external factors beyond our control, including audience reception, distribution opportunities, or third-party actions.

 

  1. LIABILITY LIMITATIONS

 

We are not responsible for:

 

14.1. Technical failures, lost data, or submission errors beyond our control.

14.2. Any financial losses, reputational harm, or damages resulting from participation.

14.3. Content misuse or unauthorized sharing by third parties.

 

Our liability is limited to the extent permitted by law.

This obligation extends to legal fees and costs incurred in defending against such claims.

We implement security measures to protect stored data, but we are not liable for unauthorized breaches beyond our control.
